Worldwide delivery with DHL EXPRESS
1.1. General Conditions
Signing up in Admedicas.com is free. The clients will have access to their personal data through a password and they can change their data at any time. The clients are not obliged to sign up and can unsubscribe whenever they want. The information we receive when a sign up is carried out is completely confidential and only ADM Global Trade srl, will have access to the data.
1.2. Pre-Contracting Information
These Terms and Conditions apply to all sales of products and services via our website (e-commerce) on www.admedicas.com which is owned and operated by ADM Global Trade srl, company registration number RO32418738 , Ing. Dumitru Zosima 77, District 1, Bucharest, Romania ("ADM Global Trade srl" or “we”) conducted by each customer procuring products and or services from webpage (the “customer”).
We recommend that customers carefully read through these terms and conditions before completing a purchase on our website. When you purchase a product from us, you accept that you have read and understood and agree to comply with these terms and conditions, which include our privacy notice. If you disagree with any part of these terms and conditions, please do not use our website or make any order from us.
Please note we only sell to companies and not private persons.
1.3. Procedure of Products Purchasing
To purchase products offered on the website, Admedicas.com will request the Users to proceed to sign up. Customers may place orders 24 hours a day on our website. We will process the order as quickly as possible and usually within 24 working hours from receipt of the order. Concerning products which are in backorder we will inform you by e-mail about the expected delivery date, maximum delivery time for out of stock items is 14 days, unless otherwise informed.
After an order has been placed, the customer will receive an order overview by e-mail. Please note that the order overview is not an order confirmation and we are not bound by the customer’s purchase order at this stage. A binding agreement is made between the customer and ADM Global Trade srl when the customer receives an email with the shipment notification, invoice and packing slip. When the customer places a purchase order in the website, this order is binding for the customer.
All orders for products are subject to availability, and ADM Global Trade srl reserves the right to cancel any purchase order or agreement if supply is impossible.
1.4. Customer information
It is the customer’s responsibility to ensure that all customer, delivery & VAT number (where applicable) information which is provided to us is correct.
In the case that the customer makes changes about customer information, ADM Global Trade srl carries the right to verify this new information and will within 24 working hours, re-evaluate the customer’s account details for approval.
1.5. Delivery & Damaged products
When ordering a on stock item on working days (Mo to Fr) before 12.00 (CET) we will be able to ship the same day. When ordering after 12.00 (CET) we will ship your order the next working day. Standard delivery will be made in 1 - 3 days unless otherwise is described. Next day delivery is available and offered with additional costs for certain countries. The delivery time to North America, China and Russia is normally between 7-15 working days and we provide our customers with a tracking number with. When ordering an out of stock item we will inform you by e-mail about the expected delivery date, maximum delivery time for out of stock items is 14 days. If this period cannot be met, we will cancel your order and refund your payment.
IMPORTANT: In the event that it is found, upon receiving the goods from the transport agency that the packaging of the item/items of the order is/are visibly damaged, you must state this and write it on the delivery note of the transport company when signing for the order.
From there, you need notify us within 24 hours of the delivery by contacting our support team by e-mail firstname.lastname@example.org or by phone +40 720 004 774 . In all cases, you must always check that the goods have been delivered in perfect condition and if you have doubts, it is recommended that you always put "DAMAGED PACKAGING" or similar on the delivery note so that it can be claimed back later, as if not the transport company will consider that the item has been delivered in perfect condition.
ADM Global Trade srl won't take responsibility for any reports of damage during transport if the User / Buyer does not make a note of damage on the delivery note of the transport company and it won´t be possible for us to return or offer compensation for the cost of the damage to the product nor will the User / Buyer have the right to make a claim against ADM Global Trade srl.
1.6. Customs Information
When making an order to ADM Global Trade srl to be delivered in a country or area that does not belong to the European Union, it is possible that the recipient has to give import rights and taxes when arriving to its destination. This is due to the recipient of the order turns into the importer of the goods, therefore he or she should comply with all the laws and regulations applicable in such country or area.
Any extra expense to the payment of customs laws and/or dues is responsibility of the recipient. ADM Global Trade srl does not have control on such expenses, therefore it is not possible to anticipate their cost. Since the customs policy vary significantly from one country to another, we recommend you to contact the corresponding customs office to obtain more information on the import restrictions applicable to specific products.
The customs offices of some countries require to the importer of record that provides some kind of identification before proceeding with an order’s dispatch. As importer of record, you could be requested, either to you or to the person you are addressing the delivery, to provide a personal identification number.
ADM Global Trade srl is not responsible for customs detentions. If the client refuses to pay the corresponding import taxes, the goods shall be held in custody in the corresponding customs. No refunds accepted.
Please note if you place an order within the EU you do not pay taxes and duties as long as you have a valid VAT number.
1.7 Returns policy
ADM Global Trade srl accept any products returned within 10 working days notification from receipt of the product as long as the reason falls under one of the following conditions:
• The product contains manufacturing defects
• The product was damaged upon arrival
• The product was wrong received
In case of returned goods, you will be offered either replacement of goods or a 100% refund of the products returned. Your refund will be processed via the same method of payment originally used to for the purchase. No returns will be accepted after 10 days.
Once we receive your item, we will inspect it and notify you that we have received your returned item. Your refund will be issued to the original credit card used to place the order. Shipping costs are not refunded. Please note that refunds can take up to 29 working days to show on your account due to varying processing times between payment providers. Contact your bank if you need to speed up the process.
1.8 Cancellation of products
After an order has been placed, the order is binding for the customer unless ADM Global Trade srl cannot dispatch the products within 10 working days after receiving the order. In the case that ADM Global Trade srl cannot ship the products within 14 working days, the customer will be notified about this and have the choice to cancel the order.
ADM Global Trade srl does not assume any liability for compliance with legislation in the country in which the customer is established or the country into which the customer imports the products. Hence, the customer is responsible for specifying the order sufficiently for the purpose of ensuring that further wholesale or retail sale of the products meets the requirements of the relevant jurisdiction, e.g. language requirements, product registration, patient information leaflets, labelling or presentation of the product in general. The customer is responsible for obtaining and maintaining any required or relevant marketing permissions or for fulfilling any regulatory registration requirements for the products which are to be imported, marketed or sold by the customer. ADM Global Trade accept orders only from doctors, aesthetic clinics, hospitals and licensed wholesalers.
2.1 Product Recall
The customer must within 24 hours from the time when information on an adverse event came or should have come to the customer's knowledge provide any available information thereon to ADM Global Trade srl.
In this respect, an adverse event means (i) any malfunction, failure, defect or deterioration in the characteristics and/or performance of a product, as well as any inadequacy in the labelling or the instructions for use which, directly or indirectly, has, might lead to or might have led to the death of a person or to a serious deterioration in their state of health and (ii) any technical or medical reason in relation to the characteristics or performance of a product leading to systematic recall of products of the same type by the customer. The customer must no later than 7 days from receipt of the products inform ADM Global Trade srl about any and all complaints, which may refer to the products. The information provided must include a full and complete description of the complaint and any action taken in response to the complaint by the customer.
ADM Global Trade srl will notify the customer immediately in the event of ADM Global Trade srl knowledge about a product recall and will provide instructions on how to assist in returning all affected products. ADM Global Trade srl may determine the recall measures required from the customer on a recall-by-recall basis, and the customer must comply with such measures unless such instructions are in violation of the law applicable to the customer.
Without further instruction, the customer must provide ADM Global Trade srl any available documentation on seizure notices from public agencies and recall notices sent to the customer's potential subsequent customers. The customer bears its own cost in connection with product recalls.
2.2 Price and Payment Method
Our prices will be displayed in EUROS however, the User/Purchaser may change the currency on the website to their chosen currency. This price then displayed on the website when the currency is changed over, has its conversion rate calculated by the European Central Bank who send us a daily conversion rate between euros and the chosen currency. If you go onto the webpage with an IP address from a country outside of Spain, then the currency displayed may be changed over automatically to the local currency. Please note that we charge in EUROS. The User/Purchaser may request a proforma invoice in their chosen currency. The final invoice will always be sent in EUROS.
No business is conducted with EU based customers unless they carry a valid VAT number (Such condition is not applicable for customers outside EU). Therefore, all prices shown on the website are Free from VAT (Provided that EU clients have valid VAT). In order to provide most optimal cost on the delivery we calculate a customized delivery cost based on DHL courier service for each shipment.
We accept payment via credit card and from the following credit card providers: Visa, MasterCard & Maestro.
When using a credit card, payment is ONLY withdrawn from credit card when goods have been shipped and ONLY for goods that are shipped. Payment for balance orders are then only withdrawn from credit card when these goods are shipped separately.
In case you as a customer have a wish for payment with TT direct via bank it is possible too and we kindly ask you to contact us directly for bank details on email. Please note a handling fee will be added to the invoice.
Important: We handle credit card information with confidentiality, and we never store credit card information. Our payment provider hosts the form where the credit card details are entered and therefore, we never see the credit card information. We do this to ensure security. Our website only stores transaction data needed for us to make the withdrawal from the specified account when shipping the product to the customer.
All customers paying by card are subject to validation checks. ADM Global Trade srl reserves the right to delay any order if fraud is suspected.
We take precautions for printing errors, price increases and sold out items on the website and in our promotions.
ADM Global Trade srl warrants that the goods shall be of satisfactory quality and shall correspond with any specification at the time of delivery. All other conditions, warranties and representations expressed or implied by statute, common law or otherwise in relation to the goods are excluded to the fullest extent permitted by law.
ADM Global Trade srl has only obligation in relation to defective goods shall be at its option to make good any shortage or non-delivery and/or appropriate to replace any goods found to be damaged or defective and/or to refund the cost of such goods to the customer.
ADM Global Trade srl aggregate liability to the customer whether for negligence, breach of contract, misrepresentation or otherwise shall in no circumstances exceed the price paid by the customer for the goods in respect of any occurrence or series of occurrences.
ADM Global Trade srl shall not be liable to the customer for defects in the goods caused by abnormal or unsuitable conditions of storage (including in the manner in which the goods are stacked and moved within the warehouse or other storage facility) or use by, or any act, neglect, or default of the customer or any third party; for defects in the goods or discrepancies in delivery, unless notified to the seller within 24 hours of receipt of the goods by the customer, or where the defect would not have been apparent on reasonable inspection, within 10 days of delivery; for defects in the goods arising from any drawing, design or specification supplied by the customer; if the total price of the goods has not been paid; unless the customer with the ADM Global Trade srl prior authorization, returns alleged defective goods, freight prepaid to the ADM Global Trade srl point of shipment; for any indirect or consequential loss or damage, costs or expenses suffered by the Buyer, howsoever caused; or for any loss of profit, loss of sales or business, loss of agreements or contracts, loss of anticipated savings and/or loss of or damage to goodwill.
ADM Global Trade srl cannot promise that the content of the admedicas.com website is free of inaccuracies or typographical errors at all times. Neither can we guarantee that all information is up-to-date. ADM Global Trade srl may, at any time, amend the content of the admedicas.com website.
Although ADM Global Trade srl strives to display the correct texts, images and pricing on the admedicas.com website, errors may occur. If the customer has been charged the wrong amount in the admedicas.com website, ADM Global Trade srl will either issue a credit note or send a charging for the extra amount. ADM Global Trade srl, however, reserves the right to cancel any order prior to dispatch should we find that the purchase is based on erroneous information, including incorrect pricing. In such case the customer will be notified by email. If ADM Global Trade srl are unable to contact the customer, the order will be cancelled automatically.
Furthermore, ADM Global Trade srl disclaims responsibility for non-delivery due to sold out products and force majeure, including delivery failure due to our suppliers.
2.5 Applicable Law and Jurisdiction.
Any contract to which these conditions apply shall be governed by and construed in accordance with the Laws of Romania. The parties submit to the exclusive jurisdiction of the Romanian Courts.
